Terms and Conditions of Wisse Moving

1. Proposals

This proposal is valid if your move or storage is carried out within 30 days or until the date specified in the proposal. The proposal may be revised under the following circumstances:

  • If the proposal is not accepted within the specified period and you request a new service after that time. In such cases, a new proposal will be provided.
  • If you request the transport or storage of additional goods or additional services. You must notify us as soon as possible after receiving this proposal. If notified on the day of the move, these additional goods or services will not be included until a new price is agreed upon.
  • If unforeseen access difficulties arise that require additional resources or services.
  • If you request inspection measures at a warehouse while the goods are stored there.
  • If the work must be carried out outside regular office hours, on a weekend, or on a public holiday, unless otherwise agreed in writing.
  • If the volume, quantity, or weight of the goods exceeds the amount specified in the proposal.
  • If there are cost changes due to currency fluctuations, taxes, surcharges, or transportation costs beyond our control.

The transportation costs in effect at the time of shipment will apply to sea, air, or land transportation.

2. Services Not Included

Unless otherwise agreed in writing, our pricing does not include:

  • Assembly or disassembly of appliances or accessories, nor the connection/disconnection of electrical appliances.
  • Lifting or installing custom floor coverings, moving loaded freezers/refrigerators, or non-disposed heat accumulators.
  • Carpentry, electrical, plumbing, cleaning, mechanical, administrative, or any third-party services not directly related to a standard moving service.
  • Disassembly or assembly of flat-packed, IKEA-style, or new furniture.
  • Drilling into walls or ceilings, or hanging furniture or accessories on walls.
  • Handling of exceptionally large or heavy items, such as American-style refrigerators, safes or security cabinets, solid wood furniture, and similar objects.
  • Special packaging or the preparation of wooden crates for especially fragile or valuable items, unless previously agreed in writing. This service may be available for an additional charge; please contact us for further details.
  • Taxes, duties, and tariffs associated with the move.
  • Port fees, terminal handling charges, and handling costs at ports and airports.
  • Storage fees, detentions, and demurrage charges at ports, airports, or terminals.
  • Costs related to fumigation and associated services, such as container transportation, handling, and other related expenses.
  • Inspections conducted by customs or other authorities, as well as any resulting charges.
  • VAT/GST/BTW/TVA, as applicable.

If an employee performs any work at your request without prior written agreement, they do so at their own responsibility, and we will not assume any liability for damages or losses incurred as a result.

3. Client Responsibilities

The client agrees to:

  • Be present or delegate a representative throughout the move.
  • Ensure that all items to be moved are properly identified and that nothing to be moved is forgotten or removed by mistake.
  • Adequately protect goods in unattended or shared premises. This includes ensuring that the goods are securely stored and organized in the event of the presence of others, such as tenants, workers, or other users. We will not assume responsibility for any losses or damages that occur in these cases due to inadequate protection.
  • Not include restricted items for transportation or storage. This includes, but is not limited to:
    • Jewelry, watches, precious metals, and stones, as well as items of high sentimental or monetary value.
    • Cash, checks, deeds, bonds, securities, or other legal documents.
    • Plants, pets, or other living organisms.
    • Food or beverages, especially perishable items that may spoil during transport.
    • Hazardous items, such as flammable, toxic, or explosive substances, or any item posing a safety risk during transport.
    • Drugs, weapons, or illegal materials prohibited by law.
    • Closed safes or closed safety boxes
    • Batteries of any kind (air freight)
    • Electric vehicles, such as e-bikes, electric scooters, or similar items, which may pose safety or regulatory risks.

These items are unsuitable for standard transportation or storage due to safety risks, legal regulations, or their perishable or hazardous nature. It is the client’s responsibility to arrange specialized transportation or storage for such goods.

  • Cover parking expenses incurred during the move.
  • Declare any item subject to customs duties or restrictions. The client must provide written and accurate information regarding:
    • Any goods subject to taxes, tariffs, prohibitions, permits, or restrictions in the country of origin, transit, or destination.
    • Regulated or controlled items, such as electronic goods, electric vehicles (e-bikes, scooters, etc.), food, medicines, alcohol, tobacco, or other items deemed sensitive under customs regulations.

The client will be responsible for any consequences arising from the omission of such information, including fines, confiscations, or delays in the move. Furthermore, the client agrees to indemnify us for any damage, expense, penalty, or liability incurred as a result of incorrect, incomplete, or undeclared information.

We recommend consulting customs authorities or relevant specialists prior to the move to confirm specific requirements related to your goods.

  • Ensure proper documentation for importation: It is the exclusive responsibility of the client to ensure that all visas, residence permits, or other required documentation are in order to authorize the importation of their goods into the destination country. The lack of valid documentation may result in consequences that will be entirely the client’s responsibility, including, but not limited to:
    • Fines imposed by the authorities.
    • Additional storage costs.
    • Expenses related to the re-exportation of goods.

We recommend verifying the legal requirements of the destination country in advance to avoid any inconvenience.

4. Route and Method

By accepting our proposal, you acknowledge and agree to the following:

  • Selection of the means of transport: We reserve the right to choose the means of transport deemed most suitable to ensure the efficiency and safety of your move, whether by land, sea, or air.
  • Subcontracting: We may subcontract part or all of the work related to your move. In such cases, the terms and conditions outlined here will continue to apply to the subcontractor, ensuring the same quality and commitment in service delivery.
  • Determination of the route and method: We are responsible for defining both the route and the method of transporting and storing your goods, prioritizing safety, speed, and efficiency.
  • Delivery under exceptional circumstances: If delivery to the agreed destination address is not possible due to circumstances beyond our control, we reserve the right to:
    • Store your goods in our facilities or in a designated warehouse in the nearest available location with sufficient storage space.
    • Consider the contract fulfilled after this delivery.

In such cases, you will be responsible for covering any additional costs that may arise, including:

  • Storage fees.
  • Handling of the goods.
  • Redelivery to the final address.

We recommend providing all relevant information regarding access conditions at the destination in advance to minimize potential logistical complications.

5. Transit Times

The transit times provided are estimates and should be considered indicative only. Actual transit times are subject to various logistical and operational factors, including but not limited to:

  • Availability of equipment, containers, and trucks.
  • Capacity, routes and scheduling of container ships.
  • Unforeseen circumstances, such as:
    • Health restrictions or pandemics.
    • Congestion at ports or terminals.
    • Strikes or labor disruptions.
    • Adverse weather conditions.
    • Changes in routes or itineraries.
    • Customs inspections or local regulations.

It is important to note that we are also dependent on the acceptance policies of shipping lines and airlines for transporting personal effects. These policies may change without prior notice.

For these reasons, Wisse Moving cannot guarantee exact transit times and will not be held responsible for delays caused by circumstances beyond our control. We recommend that clients take these factors into account when planning their move to avoid potential inconveniences.

6. Limits of Liability

Wisse Moving shall not be held liable for damages, breakages, or incidents that may occur in the following cases:

  • Circumstances beyond our control: Damages caused by external factors that are not directly within our control.
  • Unforeseen or accidental events: Includes unexpected accidents occurring without intent to cause harm.
  • Acts of third parties: Any loss or damage caused by individuals or entities not affiliated with our staff or authorized subcontractors.
  • Force majeure: Exceptional situations such as natural disasters, armed conflicts, pandemics, strikes, government restrictions, extreme weather conditions, or other similar events that prevent the normal provision of services.
  • Other unforeseeable circumstances: Any other event beyond our reasonable control that results in loss, delays, or damage.

We strongly recommend that clients purchase appropriate transportation insurance to cover any potential risks during the move. This measure can provide additional peace of mind in the event of incidents that exceed our control or responsibility.

7. Transport Insurance

At Wisse Moving, we strongly recommend that all clients purchase transport insurance to protect their goods against losses, breakages, or other incidents that may occur during transit.

While we make every effort to ensure the safety of your belongings, our liability in such cases is limited. For your peace of mind, we offer the option of contracting a specific transport insurance policy for your move. This insurance:

  • Is subject to specific terms and conditions, which we will provide at the time of arranging the coverage.
  • Covers a wide range of potential incidents, such as accidental damage, loss, or breakage.

Important Note: The insurance coverage will only take effect if it is arranged well in advance, all stipulated payment requirements are fulfilled, and the insurer confirms their approval. For more information regarding transport insurance, our team will be happy to assist you.

8. Limits of Liability for Damage to Premises

In the event that Wisse Moving is negligent, breaches the contract, or is otherwise directly responsible for causing loss or damage to your premises, our liability will be limited as follows:

  • Repair Costs: We will cover the cost of repairing the damaged area, up to a maximum of €100 per incident.
  • Limit per Property: Under no circumstances will our liability exceed €100 per property or premises affected.

These limitations reflect our responsibility policy in exceptional situations and do not affect your right to obtain additional insurance to provide broader protection for your property.

9. Exclusions of Liability

Wisse Moving shall not be held responsible for losses, damages, or harm resulting from the following circumstances:

  • Fire: Damage or loss caused by fires at any stage of transport or storage.
  • Inadequate packaging: Goods packed by the client or third parties without proper protection that suffer damage as a result of insufficient packaging.
  • Unpacking by third parties: Goods unpacked by individuals not affiliated with our team, where damage or loss occurs during this process.
  • Unattended or shared premises: Damage or loss that occurs if goods are transported to or delivered at unattended, uninhabited, or shared premises with third parties, such as tenants or workers, without proper supervision.
  • Pests: Damage caused by insects, moths, or other pests that may affect goods during transport or storage.
  • Inherent defects: Goods with manufacturing defects, natural wear and tear, inherent vices, or conditions that make them susceptible to damage during transport.
  • Conflicts and force majeure: Losses or damages caused by:
    • Wars, invasions, hostilities, civil wars, rebellions, or coups d’état.
    • Natural wear and tear, gradual deterioration, leaks, structural defects, or the perishable nature of certain items.
    • Events beyond our control, such as force majeure or natural disasters.
  • Damage from furniture assembly or disassembly: Any damage occurring during the disassembly or assembly of furniture, particularly items that are fragile, unstable, or previously assembled without adhering to the manufacturer’s instructions.
  • Indirect losses: We do not accept liability for losses resulting from:
    • Loss of use of goods.
    • Loss of employment, income, or profits.
    • Collateral damage or indirect economic consequences.

We strongly advise clients to take additional precautions and purchase appropriate insurance to protect their goods against risks not covered under these conditions.

10. Storage Services

  • Determination of the Storage Facility: Wisse Moving will determine the storage facility where goods will be stored based on availability and logistical considerations.
  • Access to Facilities: For security reasons, storage facilities are not accessible to clients.
    • If you need to retrieve stored goods, this service will be carried out by our staff for an additional fee.
    • The client will also be responsible for covering the delivery costs of goods from the storage facility.
  • Storage Insurance: Storage services do not include insurance coverage for stored goods. However, we can provide optional insurance upon request, subject to specific terms and conditions.
  • Failure to Pay: If storage fees or any other debts remain unpaid for more than 3 months:
    • We will send written notification at least 30 days in advance, requesting you to:
      • Remove all goods under our care, control, or custody.
      • Settle all outstanding debts.
  • If you fail to comply with this request:
    • We reserve the right to sell or dispose of all or part of the goods without further notice.
    • The proceeds from the sale will:
      • Be credited to your storage account.
      • Be deducted from other outstanding payments.
  • You will be responsible for all costs associated with the sale or disposal of the goods.
  • Excess Proceeds: Any remaining balance from the sale will be refunded to you without interest.

11. Payment

Unless otherwise agreed in writing, payment will be made via bank transfer.

  • Initial Deposit: 50% of the total amount must be paid at the time of booking our services. No service will be reserved without receiving this deposit.
  • Second Payment: The remaining amount must be received in our bank account on the first day of the move. This payment is required to continue with the service.
  • Credit Card Payments: We also offer the option to pay by credit card. This method is subject to a 3% banking fee on the amount paid.

Transport Insurance Coverage: For transport insurance (if contracted) to take effect, the total insurance premium must be paid at least 7 days before the start of the move.

Storage Services: Payments for storage services will be invoiced as agreed in writing with Wisse Moving, which may be monthly, bimonthly, or quarterly. Payment must be made at the start of each billing period.

A claim or dispute will not justify delaying payment of any of the amounts mentioned above.

12. Cancellation of the Move

In the event you cancel the move, the following charges will apply depending on the notice period:

  • If the cancellation is made 7 business days or less before the start of the service, a fee of 20% of the total moving cost will be charged, in addition to any expenses already incurred, such as:
    • Transportation reservations.
    • Parking permits.
    • Insurance.
    • Other related expenses.
  • If the cancellation is made 2 business days or less before the start of the service, a fee of 40% of the total moving cost will be charged, in addition to the same expenses mentioned above.

13. Right of Retention

A) Retention of Goods in Case of Nonpayment

If the agreed costs are not paid, all goods in our possession or custody will be:

  • Deposited in storage and retained until payment is made.
  • Subject to additional charges for storage services.
  • Transported to or from the storage facility at your responsibility, with all associated costs borne by you.

Before the goods are released:

  • All outstanding costs must be paid in full.
  • If payment is not made within the agreed period, interest will be applied to the total outstanding amount.

B) Right of Retention

The term “right of retention” refers to our legal right to retain goods until all outstanding debts are fully settled. This right applies to:

  • General or specific retention: We may retain all or some of the goods in our possession to ensure payment of:
    • Costs incurred for services rendered.
    • Payments made on your behalf.
  • Ongoing application: If some goods have been delivered, moved, shipped, or sold, the right of retention will apply to the remaining goods in our possession.

During the retention period, you will be charged for:

  • Storage services.
  • Any additional costs associated with the retention of goods.

14. Conclusion of Our Service

Our service is considered complete in the following cases:

  1. Delivery of goods to the final destination: Once the goods have been delivered to the agreed destination address, the service will be deemed complete.
  2. Delivery to a storage facility due to circumstances beyond Wisse Moving’s control: If delivery to the final destination is not possible due to circumstances outside our control, the service will be deemed complete upon depositing the goods in a suitable storage facility, whether owned or designated, near the indicated destination.
  3. Request for storage at the destination: If the client requests that the goods be stored in a storage facility instead of being delivered to a residence, the service will be deemed complete upon depositing the goods at the agreed storage location.
    • Responsibility for goods in storage: Wisse Moving will not assume any responsibility for the goods while they remain in storage, as they fall under the custody of the storage service provider.
    • Additional costs: Any additional costs related to storage or future delivery will be the client’s responsibility.
